The problem is that after you accepted they added another person taht WAS at war. When that happens you don't get the warning. Once you see a 3rd person in the fleet that isn't in the same corp as the inviter, you drop immediately. Its a gank.
You can turn this around on them if you feel daring though. Go ahead and join, warp with them. Right as your ship starts leaving warp, drop from teh fleet. If you time it right, you will still falsh red to the bad guys but not be a valid target, Concordokken Time it wrong and you get blown up....
Safest method is for YOU to form the fleet like mentioned above. That way you let them warp to their mission and then you follow. Course there will always be the thought in THEIR mind you are going to try the same thing to them, legitimate players will agree (setting themselves up for a gank) while most gankees will turn you down and look for someone else to help.

The warning system sucks, I've formed gangs with alliance mates and been told they weren't at war erroneously (we were forming a fleet to go kick the snot out of the corp that wardecced us!!!). Like all complicated systems there are oddities that will never get cleaned up....
Good to hear you recovered Next step, generate some funds and hire a reputable Merc corp to go slaughter them in your name.... They will normally let you "join" in the fun for free if you are paying the bills too.

I trust exactly 5 people in game; they all live within 3 hours drive from me and I have their phone numbers and addresses
I converse with several dozen on friendly terms, working and playing with them. I know the possibility exists for one of them to screw me over (and in the past one has), but in the meantime I can accept that risk for the rest of the benefits of flying with them.
Even here there is Risk vs Reward. Risk of being screwed over vs the Reward of companionship and assistance.

Big time legitimate target :P It looks like once the target lock is ATTEMPTED you are still shootable even after dropping. The window is very small (I've missed more than I've hit...)

But I do think that something should be changed so that fleet members can not shoot each other in high sec. Too much room for abuse, and I dont think it adds anything to Eve.
Unfortunately your corp/alliance doesn't get reciprocal shoot rights. They will sit there helplessly watching you die.

Yeah, but Alliance CAN'T either Makes logistics working on mining ops and such an annoyance. Your cover ships need to either be in teh same corp as the mining barges or they need to drop the cans for the barges to put ore in. And all the cover needs to be in the same corp.

Eve is a LOT easier than when I started in Sept '06, I agree with you. Misions are easier, ISK is easier to get, you start a lot stronger and there is even more info on how to succeed than there was. You could even help people without it being guaranteed a gank attempt.
What isn't easier is the suiciding and such. You could jet can mine all day IN JITA in '06 without incident. You never had to worry about a T1 hauler with 20m of stuff getting popped. Now idiots try to take on AFs at the gates that are carrying 3m of T2 rockets WITH THEIR TANK RUNNING. (That was funny )
So Eve is easier, but more dangerous in many ways.

Nope! Not if that is your goal, or you aren't concerned about such things. You fit the former, I fit the later
But newer players still think it is harsh even with all the softening. Tells you how numbed we have become, right?
